GENERAL TERMS
§1. General Terms and Conditions

For all orders in our online store asketic.tools apply exclusively these terms and conditions. We do not recognise any other terms and conditions unless we have expressly agreed to them in writing.

Your contractual partner is JDG Anastasiia Orekhova (hereinafter referred to as "Asketic Tools", "us" or "we").

By using asketic.tools or placing an order, you agree to the terms and conditions set forth herein (the "Terms"). It is important that you make sure that you have read and understood the terms and conditions before placing an order.

Persons wishing to place an order must be of legal age, i.e. at least 18 years of age.

We may change these Terms and Conditions from time to time without prior notice. The version of the Terms and Conditions applicable to your order will be the version available on asketic.tools at the time you place your order.

§2. Acceptance of orders

Once your binding offer has been submitted to us, you will receive an order confirmation by email which will include your billing and delivery address, the order number, details of the products you have selected, the final price and the delivery method. Please note that this email does not constitute acceptance of your offer or order, but merely confirms that we have received your order.

If for any reason we are unable to fulfil your order, we will notify you as soon as possible. If we have already received payment for that order, we will attempt to refund the appropriate amount using the same payment method you used. If it is necessary to make alternative arrangements, we will inform you and ask you to contact Asketic Tools Customer Services who will process the refund.

§3. Prices

The prices displayed on asketic.tools do not include VAT and shipping costs until the checkout page.

We may change the products displayed on the websites at any time and without notice. These changes do not affect products already ordered.

The total price of your order is the purchase price of the product(s) you have selected, including VAT and any additional costs (e.g. shipping costs etc.).

The total price of the products ordered is due when you place your order on the Website.

§4. Reservation of title

Asketic Tools retains title to the Products ordered by you until the purchase price has been paid in full. You hereby grant Asketic Tools a security interest in such products until full payment is received. If you are in arrears with the payment of the purchase price, Asketic Tools may demand the return of the delivered goods. You must comply with this request immediately.

§5. Payment methods

You can pay for your goods in several ways, as described below:
- Debit or credit card. (VISA/Mastercard)

§6. Availability

We cannot guarantee that any product or service will be available at all times on asketic.tools, even if it was available at a particular time. We reserve the right to remove products from sale at any time.

In the event of any errors in product or service information displayed on asketic.tools (including typographical errors and any inaccuracies or omissions in product descriptions, prices, promotions, offers and availability), Asketic Tools reserves the right to cancel orders or refuse service.

§7. Delivery and shipping costs

Asketic Tools and its distributors reserve the right to limit delivery in certain regions during certain seasons, if bad weather conditions affect delivery.

Our deliveries are subject to availability. If an item is sold out or currently not available, it cannot be ordered.

Any claims for damages due to non-availability of items are excluded.

The delivery time depends on the selected method of payment and the delivery deadlines specified in the shipping terms of the shipping service provider.

Shipping costs:
The shipping costs will be clearly displayed to the customer during the ordering process and specified on the order confirmation.
Asketic Tools reserves the right to change or adjust the shipping cost provisions at any time. Any such changes will be clearly communicated to the customer prior to the conclusion of the contract.
Customs and Import Fees:
You are fully responsible for any customs or import charges that may be incurred in connection with delivery outside the European Union (EU). Asketic Tools assumes no liability for such charges and is not obligated to reimburse or pay them.
It is recommended that you check the applicable customs and import regulations in the recipient country before placing an order and ensure that you assume all required duties and fees. Asketic Tools will provide all necessary documents and information to assist with the customs and importation process, but the responsibility for payment of these charges rests solely with you.

§8. Right of withdrawal and Return

Asketic Tools guarantees a full refund for all returned items, provided that all items are returned in the condition they were in when received. This means that the items must be undamaged, not soiled, unaltered and unworn (except for fitting) and that all labels or stickers must be intact.

If you choose to exercise your right of withdrawal and return the goods by post, you will be responsible for the direct cost of returning the goods. This also applies to partial withdrawal.
We will cover the direct costs of return shipping if the withdrawal is due to a defective item delivered by us.
The withdrawal period is fourteen days from the day on which you or a third party, other than the carrier and indicated by you, acquires physical possession of the goods.
To exercise your right of withdrawal, you must inform us (support@asketic.tools) of your decision to revoke this contract by means of a clear statement, providing the information regarding the goods acquired from us, the date of acquisition, as well as the name and address of the consumer, via email. The instructions for the return process can be found in the linked instructions.

§9. Liability of Asketic Tools

Nothing in these terms and conditions excludes Asketic Tools liability for matters for which it would be unlawful for us to limit or exclude our liability.

We do not seek to exclude liability for fraudulent misrepresentation by us, our employees or agents. However, if we breach these terms and conditions, we will only be liable for losses that are a reasonable and foreseeable consequence of such breach.

Asketic Tools shall not be liable for any indirect loss which is incidental to the principal loss or damage, such as loss of profit or loss of opportunity; or for failure to deliver the Goods or to perform any of our other obligations under these terms and conditions if such failure is due to an event arising from any cause beyond our reasonable control, including but not limited to fire, flood, storm, riot, civil commotion, war, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order at asketic.tools is limited to the total price of your order.

§10. Product characteristics

The products offered on our website are manufactured and described with the utmost care. We endeavour to show the colours and characteristics as realistically as possible. However, please note that there may be variations in colour due to different monitor settings. Handmade goods may vary slightly in size and weight. Our goods is made from high quality materials and complies with current legislation. Please note that due to the nature of the materials used, there may be natural variations in colour and pattern which are not considered defects. We do not accept liability for any damage caused by improper use or care of the goods.

§11. Guarantee

If the items you purchase prove to be defective, Asketic Tools will comply with all statutory warranty provisions. We guarantee that the goods we offer are free from defects in material and workmanship at the time of purchase. Should such a defect occur, please contact us immediately so that we can rectify the problem.

The warranty period is 30 days from the date of purchase.

The warranty does not apply to damage caused by improper use, accidents or improper care.

In the event of a justified warranty claim, we will cover the cost of repair or replacement of the item in question. We reserve the right to replace the item in the event of a valid warranty claim if repair is not possible or would be unreasonably expensive. This warranty does not affect your statutory rights.

§12. Assignment

Asketic Tools reserves the right to assign or pledge to third parties any claims for payment arising in connection with the supply of goods.

§13. Severance

If any part of these terms and conditions is found to be unlawful, void or for any reason unenforceable by any court or regulatory authority, the remainder of these terms and conditions shall continue in full force and effect.

§14. Ownership of intellectual property rights

All intellectual property rights, such as trademarks and copyrights on asketic.tools, remain with the owner.

Any use of asketic.tools or its content, including copying or storing such content in whole or in part, other than for your personal, non-commercial use, is prohibited without the permission of Asketic Tools.

This document informs Users about the technologies that help this Application to achieve the purposes described below.
